I have read and agree to
the following terms and conditions.
Tour Reservations and
Payments Policy: A
deposit of $500 per person is required within seven days of receipt of
your signed reservation form to confirm your reservation on a tour.
Your final payment is due no later than 60 days prior to the tour
departure. RIDE AMERICA reserves the right to cancel your booking and
apply cancellation charges as indicated herein should payments not be
received within the specified periods. All payments must be made in U.S.
dollars. Cancellations and Refunds Policy: All requests for cancellation
must be received in writing. Depending on when you cancel your tour,
charges will be assessed as follows:
* An administrative charge of
$50 when
canceled 90 or more days prior to tour departure.
* The deposited amount when canceled 89-60 days prior to tour departure.
* 50% of full tour cost when canceled 59-30 days prior to departure.
* 100% of full tour cost when canceled less than 30 days prior to tour departure.
No allowance or refund can be made for any
accommodations, excursions or portions of the tour in which you do not participate,
regardless of reason. WE STRONGLY RECOMMEND TRIP CANCELLATION INSURANCE.
Responsibilities: We
believe it is our responsibility to properly arrange your
tour. However, RIDE AMERICA, its subsidiaries and/or associated agents
and companies shall not be held responsible for and shall accept no liability in
respect of any claims, losses, damages, costs or expenses arising out
of:
a) personal injury, sickness, disease, accident or death, however
caused, including without limitation, while engaged on, or by reason of,
any RIDE AMERICA tour whether due to ownership, maintenance, use,
operation or control of any motorcycle, automobile, vehicle, hotel,
common carrier or any other conveyance used in the tour;
b) loss or damage to or delay of baggage or other property unless
resulting from RIDE AMERICA’s negligence in which case RIDE AMERICA’s
liability shall be limited to the actual loss but in no event would
exceed the total tour cost;
c) failure, delay or other irregularity, acts or omissions and loss
resulting there from occurring during a RIDE AMERICA tour due to actions
of hoteliers, carriers and other independent suppliers, or due to
government action, weather, mechanical breakdown, equipment failure,
labor disputes, sickness, acts of war, insurrection, terrorism, Acts of
God or any other causes beyond RIDE AMERICA’s direct control.
RIDE AMERICA reserves
the right to cancel or change any tour itinerary, feature or hotel in accordance
with operating requirements or circumstances. RIDE AMERICA constantly strives to
improve tour itineraries and features. If such improvements can be made,
or unforeseen circumstances beyond our control make changes necessary,
we reserve the right to vary itineraries and to substitute hotels and
routes. RIDE AMERICA is not responsible for any other travel
arrangements affected due to tour cancellations or changes.
RIDE AMERICA strongly recommends that a safety helmet be worn while
operating or riding on a motorcycle. RIDE AMERICA expressly
prohibits tour participants from consuming alcohol or taking illegal
drugs while riding on tour. Furthermore, anyone found
to have taken illegal drugs immediately prior to, or
during the course of, any day’s ride on an escorted tour may be prohibited from riding for
the remainder of the tour. RIDE AMERICA reserves the right to decline to
accept or retain any person as an escorted tour participant at any time. Under no
circumstances can RIDE AMERICA be held responsible for snow, rain or
other weather conditions, nor can any tour participation be canceled or
amended by you at any time on the basis of rain, snow or other weather
conditions. If your motorcycle becomes inoperable or is stolen, RIDE AMERICA will not be liable
for resultant tour interruptions, missed reservations or other expenses incurred.
Waiver Agreement:
Your payment of a deposit and your signature on this form constitutes
your
acceptance and understanding of the terms, conditions, and information
contained herein. You further understand and accept that the RIDE AMERICA
tour and its activities involve risk of personal injury or death and
damage to or loss of property. In consideration of the benefits to be
derived from your participation in this tour you hereby accept all risks of
personal injury and property damage arising from your participation in
this tour, and you hereby agree that you, your dependents, heirs, executors
and assigns do release and hold harmless RIDE AMERICA and its employees,
owners, directors, trustees and representatives from any and all claims,
including claims of illness, bodily injury, death or property damage or
loss, however caused, arising from or related to this RIDE AMERICA tour.
Further, by signing this form you certify that you do not have any physical,
mental or other condition or disability that would create a hazard for
you or any other tour participants. You also certify that you are over 25
years of age and are in possession of a current valid motorcycle operator’s
license, and you understand that the choice of wearing a safety helmet and
other protective gear is solely your own. You have carefully read these
terms and conditions and this waiver agreement, and you will abide by
everything as stated herein or elsewhere published by RIDE AMERICA.
